Electronic Communications Consent

Please read this Electronic Communications Consent (“Consent”) carefully. It contains important information.  In this Consent, “we,” “us,” and “our” refer to YOSEMITE FARM CREDIT, ACA AND ITS SUBSIDIARIES, YOSEMITE LAND BANK, FLCA, AND YOSEMITE PRODUCTION CREDIT, PCA (collectively, “Yosemite Farm Credit”) and its current and future affiliates. “You” and “your” refer to the person giving this consent.  “Communications” means each disclosure, notice, application, agreement, promissory note or other evidence of debt, undertaking, fee schedule, inquiry, periodic statement, prospectus, request, trade confirmation, response to a claim, transaction history, privacy policy, record, document or other information of any kind we may provide to you, or that you may sign or submit or agree to at our request, either now or in the future.

For certain consumer transactions (meaning transactions you are entering into with us for personal, family or household purposes), we are required by law to provide you with certain information related to the transaction “in writing” — which means you have a right to receive that information on paper. However, with your consent, we may provide this information to you electronically, instead.

For both consumer and business transactions, we also need your general consent to use electronic records and signatures.  Your electronic signature on the Communications related to your transactions with us will be just as enforceable as signing the same Communications on paper using a handwritten signature.

  1. What Information We Will Provide Electronically.
    This Consent and your consent apply to all Communications that we may provide to you now or in the future.  Your consent does not mean that we are required to complete any transaction or provide any Communication to you electronically.  We may, at our option, complete any transaction and deliver any Communication to you on paper should we choose to do so.

  2. Methods of Providing Communications to You Electronically.
    All Communications that we provide to you in electronic form will be delivered either (1) via equipment and software we provide;  (2) via e-mail or text message, (3) by your accessing a website that we will designate in an e-mail, text message or other electronic notice we send to you at the time the Communication is available,or (4) to the extent permitted by law, by posting or displaying the Communication on a website or in an application. We may establish security procedures you will have to follow to access the website.

    We may phone you or send you text messages. You consent to our leaving prerecorded/artificial voice messages and using an automatic telephone dialing system to call or text your mobile/cellular telephone number. Our calls and text messages to your mobile/cellular telephone numbers could result in charges to you.

    We may always, in our sole discretion, provide you with any Communications on paper, even if you have authorized electronic delivery.  Sometimes the law, or our agreement with you, requires you to give us a written notice.  You must still provide these notices to us on paper, unless we tell you how to deliver the notice to us electronically.

  3. Your Right to Obtain Paper Copies.
    You will have the opportunity to print out and retain a copy of all the Communications you review or sign as part of your transactions with us.

  5. Updating Contact Information
    Contact information may be updated by following any procedures for doing so that are set forth in the Communications we provide to you.

  7. System Requirements to Access Communications
    To receive electronic Communications in our offices, you will need to use the hardware and software that we provide to you. To access Communications you must also have an active email address, and have access to:  
    • an Up-to-Date Version (defined below) of an Internet browser we support (including Microsoft Edge, Chrome, Firefox, and Safari),
    • a connection to the Internet,
    • an Up-to-Date Version of an email management program,
    • an Up-to-Date Version of a program that accurately reads and displays PDF files (such as Adobe Acrobat Reader), and
    • a computer and an operating system capable of supporting all of the above. You will also need a printer if you wish to print out and retain records on paper, and electronic storage if you wish to retain records in electronic form.
      In some cases, you may also need a specific brand or type of device that can support a particular software application, including an application intended for particular mobile or handheld devices.   By “Up-to-Date Version,” we mean a version of the software that is currently being supported by its publisher. Beta versions of software are not supported.

  9. How to Withdraw Your Consent.
    You may withdraw your consent to receive Communications electronically at any time by informing our representative conducting your transaction, if in person, or by contacting us by phone at 1-866-837-1838 or by email at yfconlinebanking@yfc.ag. Withdrawing your consent may delay your transactions with us.  You may be required to restart the transaction via paper, or you may be unable to complete the transaction at all.  In addition, if we offer a discount now or in the future for conducting business electronically, a withdrawal of consent could result in the removal of any such discount. A withdrawal of your consent to receive electronic Communications will be effective only after we have had a reasonable period of time to process your withdrawal.

    Your withdrawal of consent will be effective after we have a reasonable period of time to process it. If you withdraw consent before the transaction is complete you will be unable to proceed electronically.

    Your withdrawal of consent does not affect any other consent you have given us at any other time to use electronic records and signatures. If this is a business transaction, withdrawing consent also does not affect any separate agreement you make in your Communications with us to use electronic records and signatures in the future.  In the event of a conflict between this Consent and those Communications, the Communications will control.

  11. Consumer Transactions.
    With respect to consumer transactions, you have the following additional rights:  
    • Obtaining paper copies – You have a right to obtain paper copies of any Communications we are required to provide you “in writing.” In addition to having the opportunity to print copies of Communications you review and sign as part of a transaction, you may also request a paper copy of any Communication provided to you electronically by contacting us at the customer service telephone number associated with the loan, service or account being established as part of the transaction, provided that:
      • we receive your request within 12 months after the date the Communication is first delivered to you, and
      • you provide us with sufficient information to identify the transaction and the Communications you are requesting.
      We may charge you a service fee for any paper copies that you request.  Any service fee for  paper copies you request will be disclosed to you before you are charged.  
    • Updating contact information – You may also update your contact information with us at any time by contacting us at the customer service telephone number we have provided to you.
    • Changes in hardware or software requirements – If our hardware or software requirements change, and that change creates a material risk that you would not be able to access or retain Communications, we will give you notice of the revised hardware or software requirements. Continuing to access information electronically after receiving notice of the change reaffirms your consent.
    • Withdrawing consent – If at any point you do not wish to continue to receive Communications electronically, you may also withdraw your consent by contacting us at the customer service telephone number we have provided to you.

  13. Agreement and Consent.
    By agreeing to this Consent:  
    • You acknowledge that you have read and understand this Consent about the use of electronic records and signatures;
    • You consent to the use of electronic signatures and records in connection with your transactions with us;
    • You consent to receive Communications electronically in connection with your transactions with us;
    • You acknowledge that you are able to receive, access, and view the Communications presented electronically via the methods described above;
    • You are giving consent on behalf of all co-applicants and co-account holders, and any person for which you are acting as an authorized representative, and you represent and warrant that you have authority to do so; and
    • You acknowledge that the electronic signatures and records will be in place of written documents and handwritten signatures.
